Prices do not include installation, or shipping and handling unless specified. California sales tax will apply to materials sold to California locations. Installation charges indicated are for "Basic Installation", and are estimates for "normal" situations. The installer may revise installation labor estimates based upon actual time and materials required to mitigate unusual location requirements or special customer requirements and requests..

Definitions: “Company” or “ACC” means Advanced Communications Company and ACC Satellite; “Customer” means the person(s) who requested, the person(s) who received, and the person(s) who benefited from the materials and services delivered (jointly and severally).

1.  MINIMUM SUBSCRIPTION REQUIREMENT. As a condition of equipment provision customer agrees to begin a service subscription within TEN days, and maintain service subscription on all equipment without interruption of any kind. See face of this invoice and/or promotional agreement and/or lease agreement for the specific minimum service level and minimum duration.

Customer agrees to pay ACC $200 PER unit for early cancellation or other disqualification of the minimum subscription requirement.

2. REFUNDS & CREDITS. 15% Restocking Charge. Items must be returned within TEN days in new condition and with all packaging, owner’s manuals, remote controls and all items originally packed with the unit. Program subscription balances are tied to receivers, therefore all balances must be fully paid. Special order deposits, replacement parts, special order, close-out and non-stock items are not returnable.

3. LABOR & INSTALLATION: The retail price of any labor and materials embedded in a service or installation are non-refundable. The retail installation price of a basic one-unit: HughesNet or WildBlue system is $199; DISH or DIRECTV is $149, plus $50 for each additional unit and is not refundable. DEFERED INSTALLATION CHARGES: All such labor and installation charges become due and payable if Customer fails to maintain qualification for any applicable promotional credits or consideration (such as “Free” or reduced price installation).

4. 3rd PARTY BILLING. As a service to you we may be billing a 3rd party for materials, labor, rebates and/or credits. In the event that the 3rd party fails to pay, or reclaims any such payments the Customer shall be liable for all such payments, including all promotional credits & consideration.

5. PAYMENT TERMS. All charges for goods, services, fees, and taxes are due upon delivery. A 1.5% service charge will be applied to all past due accounts each month. If Company uses any collection agency or attorney to collect money from Customer or to assert any other right which Company may have against Customer, Customer agrees to pay to legal and reasonable costs, including, but not limited to, the costs of the collection agency, attorney fees and court costs.

6. Returned Checks are subject to a $25 check return charge, plus collection and other costs.

7. CREDIT CARD AUTHORIZATION. Customer authorizes immediate debit to any credit card accounts that may be on file with the Company for any and all charges due, and those that subsequently become due.

8. Programming sold separately. After the provision of equipment it may be necessary to pay service subscription fees. TV, Audio, Data and other service delivery typically require a legal “subscription” and separate reoccurring payment for such services.

9. TERMS OF SERVICE.  Customer acknowledges that services, data, channels and content and their availability, restrictions, conditions, satellite locations, taxes, fees and rates are subject to change without notice. Significant restrictions apply to all offers and hardware and programming availability. See service provider agreements and policies for additional restrictions and conditions upon the delivery and use of signals, services and content, and subscription and fee billing policies and rates.

10. COMPANY does not provide content.  Company does not create, provide or deliver channels, programs, or other content; therefore Company does not warrant or guarantee these items in any way.

11. CONSENTS AND PERMITS. Customer represents and warrants that Customer is the owner of record of the Premises, or if the Customer is a tenant, the Customer has obtained the consent of the owner of the record of the Premises to the transaction contemplated herein. Customer is responsible for obtaining all required consents, approvals, building permits for the installation and operation of the equipment. If Customer is not the owner of the Premises, Customer agrees to indemnify and hold Company harmless from any and all claims of owner or interested parties arising out the work performed.

12. WIRING. Customer authorizes Company to install cabling, make connections and perform other tasks deemed necessary to enable Company to provide the Equipment/Service; including connecting to, utilization of, and making attachments to any existing inside wiring of the premises.

13. INDEMNIFICATION. Customer indemnifies and holds Company and each of its owners, employees, agents, affiliates, independent contractors harmless from any and all claims, (including attorney fees, witness fees, and other expenses) for damage to property or for injury to any person, employee, agent, servant, independent contractor, employee of any agent or independent contractor or any agents, or any guest or occupant of Customer in any way arising from the installation, maintenance, provision, removal or service of equipment, and from enforcement of this contract.

14. THE COMPANY SHALL NOT BE LIABLE FOR THE INCEDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THIS PRODUCT, OR ARISING OUT OF ANY BREACH OF WARRANTY. THE COMPANY EXCLUDES AND DISCLAIMS ANY AND ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILTY AND FITNESS FOR A PARTICULAR PURPOSE.

15. NOTICES. Notices to Customer shall be deemed given when deposited in the US mail or hand delivered to Customer’s last known address. Notices to Company shall be deemed given when received by Company at the address on the invoice by US mail or courier.

16. READ MANUALS. Customer is solely responsible to obtain, read and adhere to all manufacturers owners manuals; operation, installation and  safety data; and all other notices, regulations and laws pertaining to the safe and proper installation, handling, transportation, storage, disposal and usage of equipment.

17. SPECIAL OFFERS. Most promotional and special offers have separate set of minimum subscription requirements, terms, conditions and early cancellation penalties. Read those offers for details. Failure to comply with all requirements of a promotion constitutes disqualification of the related promotional credits, benefits and discounts, and is a breach of the Minimum Subscription Requirement contained in item #1 of this contract.  

18. EQUIPMENT OWNERSHIP: The Company maintains ownership of all property provided herein until all obligations of the customer(s) have been satisfied. Leased/rented/loaned equipment remains the property of the company. Failure to return all such equipment to the Company (in good condition) within TEN days of demand or service disconnect (which ever is earlier) will result in charges for that equipment at the then current retail price(s) of each item.

19. CLERICAL ERRORS. Obvious quotation or invoice clerical and stenographic errors of the seller or buyer shall be subject to correction.

20. BUILDING INTEGRITY. Customer is responsible to inspect, seal and maintain all roof and building penetration points, and is responsible for all repair and restoration work after removal of the equipment.

21. TAXES: Customer is responsible for all sales, use and all other taxes applicable to any aspect of this transaction.

22. MISCELLANEOUS.

-Company is not responsible for problems with the operation of Customer’s TV or Customer’s other equipment and does not provide service for TV receivers, computers or any other equipment even if it is attached to the Equipment.

-If any provision herein is declared to be illegal or in conflict with any law or regulation that provision may be modified or deleted at Company discretion, without affecting the validity of the remainder of these Terms and Conditions. 

-Digital to Analog Converter boxes are non returnable. Warranty claims must be made to the manufacturer. Warranty does not include on site trip charges, labor charges, signal reception devices or anything else not packaged with the converter box. See www.dtv2009.gov regarding government coupons.

Satellite signal reception requires that you have and that you maintain a clear "line of site" path from your satellite dish to the satellite(s) providing signal(s). Satellites and their locations are subject to change without notice. Certain services may move from one orbital location to another (different) orbital location in the sky. Satellites have and can fail, program providers may fail, and various failures or acts of god may temporarily or permanently discontinue satellite signals.

Broadband Services: Stated speeds are not guaranteed. Actual upload speed will likely be lower than speed indicated during peak hours. Speeds may also be temporarily slowed in cases when patterns of system usage exceed the threshold for an extended period of time. See the relevant "Fair Access Policy" for more information.

Satellite Broadband Services are not recommended for some time-sensitive types of Internet uses because of the latency of satellite Internet access. Latency is usually not noticeable in general Web browsing, but may have an adverse impact on uses that are subsecond and/or time-sensitive. Examples include online gaming ("twitch" and RPG games), VoIP (Voice over Internet Protocol), Internet phone service, VPN (Virtual Private Network), auctioning and day trading. We urge YOU to discuss the potential usage of a satellite broadband with the relevant application vendor to determine for yourself if such a broadband service is suitable for your needs, we make no guarantees in this area.

Typical broadband installations include providing a single Ethernet connection to a single operational and pre-configured (to accept DHCP) computer. Depending upon your application - customer premises networking adaptors, cabling and/or equipment and the configuration of those items may be required and is not included.

Understand that all computers connected to a single broadband modem will be sharing the bandwidth available to that single connection, and is subject to any applicable Fair Access Policy. Actual speeds may vary. Speed and uninterrupted use of service are not guaranteed.

Customer understands that the Internet is not owned, operated, managed by or in any way affiliated with the Company and that all content, services, information and other materials that may be offered, made available, or are accessible on the Internet are offered, made available, or are accessible solely by third parties who are not affiliated with Company or its affiliates. 

Use of the Internet by users is solely at the respective user’s own risk and is subject to all applicable Laws.  Company does not warrant that the Data Services will be uninterrupted or error-free, or that any information, software, or other material that may be accessible via the Data Services, is free of viruses, disabling code, worms, or any other harmful components. Customers are solely responsible for their own security, screening, filtering, privacy, and to establish their own virus/worm detection, firewalls, VPN’s, etc if so desired. 

Without limiting anything contained herein, Customer further understands that the Internet contains unedited materials, some of which may be sexually explicit or may be offensive to some people and that Customer’s access to such materials are at Customer’s own risk.  Company has no control over and accepts no responsibility of any kind for such materials.
